The town of Plymouth seeks qualified applicants for the position of LABOR and EMPLOYMENT COUNSEL for the town’s Legal department.
Working under the general direction of Town Counsel, this position provides expert legal services and strategic guidance on all labor and employment matters affecting the Town. This position is responsible for advising on labor relations, collective bargaining, workplace investigations, disciplinary matters, and compliance with federal and state employment laws. This position will work closely with the Assistant Town Manager, the Human Resources Director, department/division Heads and union representatives to promote positive labor-management relations and mitigate legal risk. Represents the town in arbitration, mediation and fact-finding hearings before the American Arbitration Association and Department of Labor Relations. Advises management on contract interpretation, disciplinary actions, and other employment-related matters. Provides counsel on compliance with state and federal employment laws, including but not limited to M.G.L. Chapter 150E, FMLA, Parental Leave, ADA, FLSA, Title VII, workers compensation, and other applicable laws. Provides counsel on civil service matters in accordance with MA General Laws Chapter 31 and Chapter 41. Acts as backup to General Counsel in their absence and may assist in other legal matters including, but not limited to, Host Community Agreement application reviews, Open Meeting Law and Ethics complaints, Regulatory and Land Use reviews, contract disputes and litigation. Performs similar or related work as required or as situation dictates.
Juris doctor degree from an accredited law school, admitted to practice in Massachusetts, and admitted or eligible for for Federal Bar membership. At least ten years’ legal experience, at least half of which must be in a municipal setting as public or private counsel; or an equivalent combination of education and experience
